Trump Found Guilty of Sexual Assault and Defamation
A jury ordered former President Donald Trump to pay E. Jean Carroll $5 million in damages for sexual abuse and defamation on Tuesday.
Background: Carroll initially accused Trump of sexual assault in 2019, alleging that he forced himself onto her in a dressing room of a department store in New York City in the mid-90’s. Trump denied the allegations, which prompted Carroll to sue him for defamation. In 2022, she filed a second lawsuit after New York created the Adult Survivors Act, which gives adult survivors of sexual violence a 1-year window to sue over attacks that occurred decades ago.
Why it matters: At least 26 women have accused Trump of sexual misconduct or assault and this is the first time where he has been held legally accountable for his actions.
No jail time? Carroll brought a civil case, which provides an easier path to conviction, but comes with no jail time. A criminal case comes with a prison sentence. However, Carroll would have to prove beyond a reasonable doubt that Trump raped her. Since the incident occurred nearly 30 years ago, obtaining concrete evidence to support her claim would be almost impossible.
What’s next? Trump claimed he had no idea who Carroll is throughout the trial and his lawyers said they will appeal the verdict. Carroll won’t receive any of the damages until appeals have been sorted out.
